This Vacation Home Rental Agreement 2025 (this “Agreement”) dated _______, 2025, is between Skaneateles Cottages Property Management LLC (“Landlord”) as agent on behalf of the owners (“Owner”) of the premises identified as Red Tail Retreat, 1543 Red Tail Lane, Skaneateles, NY 13152 (“Red Tail Retreat” or “Property”) and _______________(“Tenant”)

1. The premises are located on Skaneateles Lake off Nunnery Rd Skaneateles, N.Y. (the “Property”).
2. The rent, deposits, fees, and other amounts shall be payable as described above. Reservations with unpaid balances within thirty (30) days of arrival may be subject to cancellation without refund. If property was booked through VRBO or ABNB, all payments and deposits will be collected and dispersed through the booking channel.
3. Late Arrivals and Early Departures. In the event that Tenant arrives after the arrival date or departs prior to the departure date, no deductions or refunds will be granted.
4. Maximum Occupancy. The Property shall be occupied by no more than six (6) people (adults and children, collectively) staying any night; and there shall be no more than a total of twelve (12) people (adults and children, collectively) and three (3) vehicles on the Property at one time. This provision will be strictly enforced because this is a vacation rental. Breach of this provision may result in eviction without any refund.
5. No tents, campers (or other lodging structures) are allowed on the Property.
6. No Pets. No pets are allowed on the property. Breach of this provision may result in eviction without any refund. Further, Tenant understands and agrees that Landlord and Owner shall not be liable for any injury or damage caused by or to any pet that is introduced to the property.
7. No Smoking. This is a non-smoking property. Cigarettes, e-cigarettes, and vapor products are strictly forbidden. Breach of this provision may result in eviction without any refund.
8. Tenant’s Requirement to Maintain the Property. The Tenant will observe all conditions of this Agreement, will maintain the Property in clean and orderly condition, will conduct him/herself in a manner inoffensive to neighbors, and obey all laws and regulations. Any group whose behavior creates a disruption or interferes with any neighbor’s peaceful enjoyment of their property may be evicted without any refund. The Property shall be secured while unoccupied. Loss of Owner’s items within the Property that result from Tenant’s failure to keep the Property secured shall be reimbursed by Tenant to Landlord. No illegal drugs, cigarettes, e-cigarettes, marijuana (or related derivatives), or fireworks are to be present on the Property.
9. Tenant’s Property. Owner and Landlord are not responsible for the theft, loss or damage (including but not limited from fire, water or any other cause) of Tenant’s or Tenant Parties’ property from any location, or for personal property that Tenant or any Tenant Party may leave behind but cannot be located. Tenant and Tenant Parties bear the risk of damage and loss of any personal property that may, and does, occur. Tenant acknowledges and agrees that Landlord’s and Owner’s insurance does not cover Tenant and Tenant Parties’ belongings or damage that Tenant or Tenant Parties cause.
10. Security Deposits. Tenant has provided the security deposit described above. Tenant agrees to report all accidents and damage prior to checkout so necessary repairs may be scheduled. Deductions can be made for excessive cleaning (including but not limited to additional cleaning necessitated by Tenant’s violation of Paragraphs 5 and/or 6, above), damage to the Property or its contents, missing linens or other items, moving or cleaning furniture, and carpet cleaning. Tenant will be notified in writing regarding deductions. Security deposits are refunded within 30 days of departure. In addition to the security deposit, Tenant is responsible for any damage due to willfulness or negligence on the Property. Tenant will be notified in writing of any excess damages and Tenant agrees to send payment within 10 days of notification. If property was booked through VRBO or ABNB, the booking channel will manage security deposit and deductions.
11. Cancellation Fee. Vacation properties are rented far in advance. It is, therefore, difficult to fill a vacancy as the lease term approaches. Any cancellation made up to [60] days prior to reservation check in date will receive a full refund. In the event of a cancellation more than 30 days before the starting date of this Agreement, Landlord will try to re-rent the Property, with a goal of receiving the total rent indicated in this Agreement. To the extent that Landlord receives rents and other amounts from substitute tenants for the Term at an amount equal to or greater than the Total Charges described above, the Landlord will refund to Tenant any payments from Tenant. If Landlord is unable to do so, Tenant will be entitled to a refund only to the extent that payments by Tenant, when added to payments by substitute Tenants exceed the Total Charges, with the remainder of Tenant’s payments retained by Landlord. Any cancellations received by Landlord less than thirty [30] days before the starting date of this Agreement shall result in a forfeiture of all money received from Tenant and Tenant shall remain liable for the remaining Total Charges. Cancellation must be submitted to Landlord in writing.
11a. Host Channel Cancellation Fee. If there is a discrepancy between a Host Channel (VRBO/ABNB) cancellation policy, the policy of the Host Channel will supersede that of the policy described in Section 10. A website booking through Skaneateles Cottages is considered a direct booking and the policy in section 10 is maintained.
12. Liability. Landlord, Owner and their respective agents, servants, officers and owners, direct or indirect, shall not be liable for any claims with respect to (a) any death or injury suffered by Tenant or any employee, contractor, licensee, invitee, guest, agent or customer of Tenant (each, a “Tenant Party”) or any other person, from any causes whatsoever (b) any loss or damage or injury to any property outside or within the Property belonging to Tenant, any Tenant Party or any other person. In addition, Landlord and its agents shall not be liable for interference with or interruption of any utility, service, air conditioning, ventilation, or any defect in the Property. Liability to Landlord and Owner is limited to rental monies paid by Tenant. Tenant acknowledges and agrees that Tenant’s reservation for, and occupancy of, the Property is conditioned on the express and knowing assumption of all risk, responsibility and liability by all occupants and invitees for their own decisions and actions, and for their personal safety and that of their property, even in the absence of further disclosures, instructions, house rules or warnings. This Agreement is not intended as a full list of all possible risks.
13. Lake Access. Tenant, on behalf of Tenant and all Tenant Parties, understands, acknowledges and agrees (i) that lake accesspresents a variety of open and obvious risks and dangers, including but not limited to risks of injury, paralysis and/or death resulting from slip-and-fall and/or drowning; (ii) that no lifeguard or other attendant will be present; and (iii) that Tenant and all Tenant Parties intentionally and knowingly assume the risks associated with the lake access. Tenant agrees to indemnify and hold Landlord and Owner harmless from and against any and all claims, demands, suits, or judgments that may arise from the use of or access to the lake by Tenant and/or any Tenant Party, unless such damages are caused by the willful act or omission, or gross negligence, of Owner, Landlord, or their respective agents, employees, officers, or representatives.
14. Indemnification. Tenant agrees to indemnify and save harmless the Owner and Landlord for any injuries, liabilities, theft, damages cost, or expense (including reasonable attorney’s fees) whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Tenant use and occupancy of the Property.
15. Supervision of Tenant Parties. Tenant shall be solely responsible for careful supervision of all Tenant Parties and other persons in the swimming area and other areas of the Property.
